# Sole trader vs limited company van

By [the FleetMe team](https://fleetme.co.uk/about) · Updated 14 October 2026 · 7 min read

The short answer

**A limited company is a separate legal person, and that single fact changes which agreement is available, how the vehicle is taxed and what underwriting looks at. It is an accountancy decision first, but it does change what you can be offered.**

## Why the structure changes the product at all

## What actually changes

| | Sole trader | Limited company or LLP |
| --- | --- | --- |
| Legal position | The business is you | A separate legal person |
| Agreement available | Vehicle hire, up to 12 months | Business contract hire, up to 12 months |
| Called | Hire | Leasing or contract hire |
| Underwriting looks at | You, personally, and the trade | The company, its directors and affordability |
| Liability | Yours personally | The company s, subject to any guarantee |
| Vehicle tax relief | Against your trading profits | Against company profits |
| Private use | Apportioned, business share only | May create a taxable benefit for the driver |
| Filed accounts needed | No | No, new companies are considered |

## The tax works differently, and private use is where it bites

## What incorporating does, and what it does not

## So should you incorporate?

## Applying, either way

## Put a price on it

Tell us the vehicle, the term and the annual mileage you need and we come back with a written quote, and we aim to do that the same working day. Rentals are quoted ex VAT with the VAT-inclusive figure alongside, and your agreement is with FleetMe.

## FAQs

### Can a sole trader lease a van?

Not contract hire, that is for limited companies and LLPs. What a sole trader can take from FleetMe is vehicle hire over terms up to 12 months. Same vans, different agreement, shorter maximum term.

### Does becoming a limited company get me a better van deal?

It opens up business contract hire and the longer terms, but it does not make the rental cheaper. Pricing is driven by the vehicle, the term and the mileage, not by your structure.

### Do I need filed accounts to hire a van?

No, either way. New limited companies with no trading history are considered, and sole traders are assessed on themselves and their trade. None of that is a promise of approval, and we will tell you honestly if we cannot help.

### Will a van create a benefit in kind for me?

Through a company it can, where the van is available for private use, though vans are treated much more favourably than cars. Check the gov.uk guidance on company vans and your own position with your accountant.

### Should I incorporate just to get a longer agreement?

No. Incorporating brings filing, corporation tax and director duties with it, and it is an accountancy decision rather than a vehicle one. If it is right for other reasons, the wider options are a bonus.

### What if I incorporate partway through a hire agreement?

The existing agreement is with you personally and runs to its end. A new agreement in the company name is a separate arrangement, talk to us before you make the change rather than after.
